Participant Fundraising Agreement and General Release and Waiver

Welcome to the 2025 Bank OF America Chicago Marathon as a Fundraiser for Heal The Planet Together, Inc.

Marathon Date: October 12, 2025

This is your official invitation to the 2025 Bank of America Chicago Marathon Official Charity Program.

I understand that this is a legally binding document.

The 2025 Bank of America Chicago Marathon race registration process must take place on their website within 24 hours that Heal The Planet announcing that you can proceed to REGISTER, if not you will lose your spot.

A registration link will be provided to proceed with the race registration for the Marathon when you have been accepted by Heal The Planet Together, Inc.

I, the Participant, agree to raise and/or contribute the basic fundraising commitment of $2,300 for Heal The Planet Together, Inc. in benefit of Programs for the Children and to be personally responsible for the difference if I fail to raise the required funds.

*Heal The Planet Together, Inc. will be covering the marathon registration fee.

The basic fundraising commitment for I understand that the outstanding balance towards the basic fundraising commitment will be charged to my credit card if I have NOT met this requirement by the deadlines specified in this agreement.

To guarantee my fundraising commitment, I will provide credit card information as part of the HTP Team registration process valid through at least 6 months from the date of September 28, 2025.

Any balance due to reach my fundraising commitment if funds are not raised, will be billed to my credit card as follows. The Fundraising date and amount breakdown will be 50% by June 1st, 2025, - $1,150.00 at 11: 59 PM- Florida EST time. Full balance by September 28, 2025, $1,150.00 at 11: 59 PM- Florida EDT time. (2 weeks before the race)

Credit card failure to process payment will require Heal The Planet to go after the funds even legally if it is required.

I understand I will be responsible for the basic fundraising commitment whether I participate in the 2025 Bank of America Chicago Marathon or not; there are no exceptions for injury, illness, or changes in health status; pregnancy or postpartum and any funds raised before my cancellation will not be returned and I will still be obligated to submit the basic fundraising commitment. I am clear that Heal The Planet Together Inc. has the right to monitor the fundraising progress and make inquiries if necessary.

I acknowledge and agree that if the 2025 Bank of America Chicago Marathon is canceled or postponed to another date for any reason, all agreements, representations, warranties, and attestations contained herein will apply with equal force to the 2025 Bank of America Chicago Marathon and I will be obligated to submit the basic fundraising commitment.

I represent and warrant that I am physically fit and healthy to participate in the Event, and that my participation is entirely voluntary. I agree to use good judgment in all aspects of my participation in the Event, to behave appropriately, and to comply with the rules and requirements for participation.

I understand that participating in the Event exposes me to certain risks, which may include, but are not limited to, injury, illness, death, and damage to self, and/or property, whether from exertion, weather conditions, the conditions of the course, vehicular traffic, and contact with other participants. I hereby assume and take full responsibility for any and all risk of harm, injury, illness, death, or damage to myself and/or my property that may occur in connection with my participation in the Event.

I hereby grant permission for photographs, videos, and other images (collectively, the “Images”) to be taken of me during the Event and assign all rights and interests to the Images to HTP. I understand that the Images may be used by HTP and/or its designees in connection with its advertising, promotional, and marketing activities, and for other purposes authorized by HTP, including, but not limited to, use in direct mail marketing, print advertising, posters, billboard advertising, and the internet; all without any compensation to me. I authorize the use and release of my name and status as an Event participant in conjunction with the use of the Images. In consideration of my being permitted to participate in the Event as a member of the 2025 HTP Team.

In consideration of my being permitted to participate in the Event as a member of the 2025 HTP Team, I hereby, for myself, and on behalf of my heirs, executors, and assigns, waive, release, and forever discharge HTP, HTP affiliates, and their respective officers, trustees, employees, sponsors, coordinating groups, volunteers, representatives and agents, the Bank of America Chicago Marathon and any and all sponsors of the Bank of America Chicago Marathon and all others in any way associated with the Event (collectively, the “Released Parties”) from any and all liability, claims, damages, or rights of action of whatever nature or description, in equity or at law, present or future, resulting from or relating to my preparation for and participation in the Event. This means that I will not sue HTP or any of its affiliated persons or entities, or try to hold them legally or financially responsible, for any harm or injury that might relate to my taking part in the Event. I agree to adhere to all stipulations of the Bank of America Chicago Marathon Entry Form and Participant’s Agreement, Waiver, Release, and Acknowledgement as required for official entry in the 2025 Bank of America Chicago Marathon. I certify that I am aware of the physical demands and hazards of training for and participating in a marathon and that I am physically fit and will train sufficiently for participation in this event.

I hereby attest that by accepting this waiver/agreement and registering for the Event, I have read, fully understand, and agree without exception to all the provisions, releases, and waivers outlined in this Participant Agreement and General Release/Waiver form and that I have agreed to it knowingly and voluntarily. I understand that this agreement is a legally binding document that limits the legal liability of the Released Parties. I attest, under penalty of fraud, that I will be at least 18 years of age on October 12, 2025. This Release must be accepted before consideration for acceptance as a member of the 2025 HTP team in the Event.

KEY POINTS

● You are being advised that individuals not starting with the official start time of the race event will be disqualified and participants who do not complete the full course or do not finish before the course time limit may not receive an official time, listed in the results book, finish line items or other amenities.

● You are being advised that entries are non-refundable, non-transferable, and may not be deferred to future years.

● If you cancel your participation for any reason, this do not free you of the fundraising commitment, you still must raise the funds or pay out of pocket.

● You are being advised that event-issued bib numbers and timing devices must be worn only by the participant to whom they are assigned.

● All participants are required to pick up their participant packet at the Bank of America Chicago Marathon EXPO during the scheduled hours of operation and must show government-issued photo identification.

● If a runner gets injured and cannot participate, unfortunately, it does not free you from your commitment.

● Heal The Planet will provide one shirt for training purposes or to wear on race day. If you want to use your shirt, we will provide the Heal The Planet Logo so you can print it on your shirt that you desire to use for the event. You are allowed to have any other sponsor's logo on your shirt.

● The Use of Bank Of America Chicago Marathon logos cannot be used without consent, you must send me what you are planning to create, so I can send it out for their approval.

● You must get familiar and read all the instructions provided at the Bank Of America Chicago Marathon website and e-mails sent by them regarding race details.
